GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale (GTCs) apply to all orders placed on the Atelier du Tournesol online store.

2. PRODUCTS
Atelier du Tournesol offers handmade fashion jewelry for sale, including creations made from beads, plastic, and various accessories.
As each creation is handmade, slight differences may exist between products, particularly in terms of color, shape, or arrangement of the elements. These characteristics do not constitute a defect and contribute to the artisanal and unique nature of the creations.
The photographs displayed on the website are intended to present the products as accurately as possible. However, slight color differences may appear depending on the screen used.
3. PRICES
Prices are indicated in euros (€).
The prices displayed correspond to the prices applicable at the time of the order.
Atelier du Tournesol reserves the right to modify its prices at any time. However, the price charged to the customer is the price displayed at the time the order is confirmed.
Any applicable shipping costs are indicated before the final validation of the order.
4. ORDER
The customer selects the products they wish to purchase and adds them to their cart.
Before confirming the order, the customer may check the contents of their cart and correct any errors.
Confirmation of the order implies acceptance of these GTCs as well as the obligation to pay.
An order confirmation is then sent to the email address provided by the customer.
Atelier du Tournesol reserves the right to refuse or cancel an order in the event of an exceptional issue concerning the availability of a product or suspected fraud.
5. PAYMENT
Payment is made at the time of the order, using the payment methods offered on the online store.
The order is prepared after payment has been confirmed.
6. SHIPPING
Orders are shipped to the address provided by the customer when placing the order.
Shipping costs and delivery times are indicated to the customer before the order is confirmed.
In the event of a problem concerning delivery, the customer may contact Atelier du Tournesol via our contact form.
Atelier du Tournesol cannot be held responsible for delays attributable to the carrier, without prejudice to the consumer's legal rights.
7. RIGHT OF WITHDRAWAL
In accordance with the regulations applicable to distance selling, consumer customers have, except in cases provided for by law, a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to provide any reason.
To exercise this right, the customer must send their request via our contact form.
The product must be returned no later than 14 days following notification of the decision to withdraw.
The direct costs of returning the product are borne by the customer, unless otherwise provided.
The product must be returned in a condition allowing it to be resold, with any accessories and packaging.
The refund will be made under the conditions provided for by the applicable regulations.
8. PERSONALIZED PRODUCTS
The right of withdrawal does not apply to products made according to the customer's specifications or clearly personalized, in accordance with the exceptions provided for by law.
This exception applies only to creations that are genuinely personalized at the customer's request.
9. LEGAL GUARANTEES
Products sold by Atelier du Tournesol benefit from the applicable legal guarantees, including the legal guarantee of conformity and the legal guarantee against hidden defects.

10. LIABILITY
Atelier du Tournesol undertakes to provide products that conform to their description and comply with applicable regulations.
As the jewelry consists of fashion jewelry creations, customers are advised to handle them with care and to follow any care instructions provided with the product.
Atelier du Tournesol shall not be held liable for damage resulting from improper use of the product.
This clause does not limit the consumer's legal rights.
11. INTELLECTUAL PROPERTY
The photographs, texts, graphic creations, logos, illustrations, and other content displayed on the Atelier du Tournesol online store are protected by intellectual property laws.
Any reproduction or use without prior authorization is prohibited.
12. COMPLAINTS AND DISPUTES
For any question or complaint, the customer may contact Atelier du Tournesol via the contact form.
In the event of a dispute, the customer must first contact Atelier du Tournesol in order to seek an amicable solution.
13. APPLICABLE LAW
These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the jurisdiction rules applicable to consumers shall apply.
